Terms & Conditions

About these terms
These Terms & Conditions describe use of peakhumanfunction.com, its educational materials, and the PHF Performance Capacity Assessment and requested report. "PHF," "we," "us," and "our" mean Peak Human Function LLC. "You" means the person using the relevant feature.
Please read the information relevant to the feature you use. Where an agreement is required, PHF will present the applicable terms and request agreement before the relevant action. These terms do not make a website visit an authorization to charge you, subscribe you to marketing, record a meeting, or process health information without the necessary separate permission.
Paid services, programs, consultations, and third-party accounts can have separate terms. These website terms do not replace an agreed service description, professional consent, payment arrangement, cancellation/refund terms, or mandatory legal rights.
Educational information and appropriate professional care
The website's general content and free assessment/report provide educational performance-health and wellness information. They are not medical advice, a diagnosis, an emergency service, or a substitute for care from a qualified healthcare professional.
The assessment can indicate where capacity appears limited from your answers. It cannot explain why a limitation exists or determine exactly how to address it. A high score does not rule out a health problem, and a low score does not diagnose one. Take symptoms seriously even if your experience does not match the report. Do not delay appropriate care, discontinue prescribed treatment, or change medication based only on website content or assessment results.
A website visit or receipt of the free report does not by itself establish a clinician-patient relationship or enroll you in paid PHF services. The role, qualifications, scope, and terms of any separately requested professional service should be explained before that service begins. If you believe you have an emergency, contact appropriate local emergency services rather than relying on this website.
Assessment eligibility and honest submissions
The Performance Capacity Assessment is for adults age 18 and older. Complete it for yourself, using answers that reflect your own experience. Do not impersonate another person or submit another person's health-related answers without a separately authorized arrangement.
If requesting an email, use an address you control and provide accurate delivery details. Do not enter passwords, payment-card or bank credentials, identity documents, unrelated medical records, or other unnecessary sensitive information into the assessment.
Assessment results and report delivery
Scores and report priorities are automatically calculated from your responses using the assessment's rules. Results depend on the information you provide and the assessment's limitations; they are not a guarantee of present health, future performance, or a particular outcome.
You can view the initial browser-based preview without providing your name or email. A personalized emailed report requires the separate report-processing consent and necessary delivery information. Marketing is optional; declining it does not prevent the requested report.
The requested full report is normally delivered as a PDF email attachment. If PDF creation fails, PHF may send the complete report in the email itself. Delivery can be affected by incorrect addresses, provider limits or outages, mailbox rejection, filtering, and other technical issues. A sending or delivered status is not a promise that a message is visible in your inbox.
You may save or print your attachment. PHF's assessment database retains the related profile for 90 days from the report request, as described in the Privacy Policy; this is not a promise of permanent online report access. The cleanup does not remove copies already in your possession. Protect your copy and be mindful of who can access any mailbox or device on which you keep it.
Privacy and separate choices
The Privacy Policy explains PHF's relevant information practices. Consent requests for assessment/report processing, marketing, recording, and AI-assisted note-taking are separate from one another and from these terms. Acceptance of these terms is not blanket data-processing consent.
PHF may use meeting recordings or AI-assisted notes only after the necessary prior, informed permission. The tool, purpose, relevant information, and storage/retention arrangements should be explained before use. You may decline optional recording or AI note-taking and discuss alternatives. Generated notes may contain errors and require review.
Responsible use and service protection
Use the website and assessment lawfully and respect others' privacy and rights. Do not:
- Attempt unauthorized access to systems, records, accounts, or another person's report.
- Upload malicious code, interfere with service operation, or impersonate someone else.
- Use automated or repeated submissions to evade verification, request limits, suppression, or other service protections.
- Redistribute PHF materials commercially or present them as your own work without permission.
PHF uses security verification and request limits to protect the report service. It may refuse or limit a request that fails verification, exceeds limits, or presents a reasonable security risk. Such protection does not authorize PHF to disregard your privacy rights or any separately agreed paid-service obligations.
PHF content and your personal report
PHF's branding, assessment content, report templates, and other original website materials belong to PHF or their respective rights holders. You may read the website and use supplied materials for personal, non-commercial purposes, subject to any clearly stated permission and applicable legal exceptions.
You may keep and share your own report for personal use, including with a healthcare professional or adviser you choose. That permission does not authorize selling the assessment, republishing PHF templates as your own product, or using PHF branding to imply endorsement. Sharing your report can disclose sensitive information; consider the recipient and method.
Submitting information for an inquiry, report, or service does not grant PHF permission to publish it as a testimonial or use identifiable health information in advertising. Such a use would require its own appropriate permission and review.
Appointments, applications, and paid services
An inquiry, application, appointment request, or free Strategy Call does not by itself purchase a paid service or authorize payment. Any offer, fees, billing schedule, service scope, cancellation/refund terms, and required agreement should be provided separately before enrollment or payment.
PHF uses Calendly, Microsoft Teams, and Biocanic in appointment workflows; Square and OnFire Health for payment-related services; and Biocanic and Brevo for their respective client-record and relationship-management functions. The relevant provider may present additional account or feature terms. Using the PHF website does not automatically enroll you in a provider membership, authorize recurring payments, or accept undisclosed third-party terms.
These terms do not set a PHF refund deadline, cancellation charge, recurring-billing arrangement, or payment-plan rule. Any such arrangement must be clearly stated in the relevant service offer/agreement and comply with applicable law.
Third-party links and tools
The website and report can link to external pages or use connected provider tools. The provider controls its own interface and information practices as explained in its terms and notices. A link does not guarantee every statement on the destination or waive your rights against PHF for PHF's own conduct.
Please review the relevant information before submitting data, using a third-party account feature, or agreeing to payment. We do not recommend bypassing a browser's security warning to access a report or service.
Availability, corrections, and your rights
Website features can be temporarily unavailable because of maintenance, provider outages, or technical problems. PHF does not promise uninterrupted operation or that every educational item or generated result will be error-free. If you notice an error or cannot access a requested report, contact us so we can investigate.
Nothing in these terms excludes responsibility for fraud, intentional misconduct, or liability that cannot lawfully be excluded, or reduces mandatory consumer, privacy, or data-protection rights.
Applicable mandatory law determines your rights and available remedies. You do not have to abandon a regulator complaint or legal remedy in order to contact PHF about a concern.
Changes and questions
PHF may update these website terms to reflect changes to features or applicable requirements. The effective date and version on the live copy identify the current terms. Updates do not retrospectively change an already-agreed paid-service contract or authorize new processing of personal information. Where renewed agreement or consent is needed, it must be requested appropriately.
If part of these terms is not enforceable, that does not remove your mandatory rights; the remaining provisions apply only to the extent they can fairly and lawfully stand on their own.
